Undisclosed Septic System- thought we were on city sewer?

Is there any legal action we can take for discovering our home is connected to an old septic system which has backed up into our home, when we were told we are connected to public sewer and have been paying for it for the last 4 1/2yrs? Our MLS listing disclosed public sewer, which is obviously not true.
